1. Identity of the service provider

Equi Assist is a product of Domani Equestrian BV, with registered office at Soetebeek 64, 3670 Oudsbergen, Belgium. Company number: BE0660.651.954. Email: info@equi-assist.com.

By using the Equi Assist platform (hereinafter "the Service"), you accept these Terms & Conditions. If you do not agree, you must immediately cease using the Service.

2. Description of the Service

Equi Assist is a SaaS platform that supports horse dealers in cataloguing, searching and matching horses with clients. The Service includes, among others:

• Automatic processing of incoming messages (WhatsApp, email) via AI technology
• Storage and management of horse information
• Automatic matching of horses with client search profiles

3. Subscriptions and payments

The Service is offered through monthly subscriptions. Prices are exclusive of VAT unless stated otherwise. After the free 7-day trial period, the subscription renews automatically.

Payments are processed through Mollie. By subscribing, you authorise automatic monthly debits. You can cancel your subscription at any time via your account settings. Cancellation takes effect at the end of the current billing period.

4. User obligations

You agree to:

• Provide accurate and up-to-date information upon registration
• Keep your login credentials confidential
• Use the Service exclusively for lawful purposes related to horse trading
• Comply with applicable legislation, including the GDPR, when entering personal data of third parties (clients, suppliers)

5. AI processing and accuracy

The Service uses artificial intelligence (AI) to process messages and extract horse information. AI results are indicative and may contain inaccuracies. Domani Equestrian BV does not guarantee that AI-generated data is complete, correct or up-to-date.

The user remains responsible at all times for verifying information generated by the Service before making decisions based on it, including but not limited to prices, horse characteristics and client matches.

6. Liability

Domani Equestrian BV provides the Service "as is" and "as available". To the fullest extent permitted under Belgian law, all liability for indirect, incidental, special or consequential damages is excluded, including but not limited to lost profits, missed sales, loss of data or business interruption.

The total liability of Domani Equestrian BV under this agreement is in any case limited to the amount paid by the user in subscription fees during the 3 months preceding the claim.

Domani Equestrian BV is not liable for: (a) inaccuracies in AI-generated data; (b) loss of data due to force majeure or third-party outages; (c) damage resulting from unauthorised use of the Service by the user; (d) decisions made by the user based on information from the Service.

7. Intellectual property

All intellectual property rights in the Service, including but not limited to software, design, logos and documentation, belong to Domani Equestrian BV. The user is granted only a limited, non-exclusive, non-transferable right of use for the duration of the subscription. The user is prohibited from:

• Copying, modifying or reverse-engineering the Service
• Making the Service available to third parties without permission
• Using automated systems to scrape or extract data from the Service
• Using the Service to develop a competing product

The user retains all rights to the data they enter into the Service.

8. Data processing and privacy

Domani Equestrian BV processes personal data in accordance with the General Data Protection Regulation (GDPR) and Belgian implementing legislation. Please refer to our Privacy Policy for detailed information on the processing of personal data.

To the extent that the user enters personal data of their clients or other third parties via the Service, the user acts as the data controller and Domani Equestrian BV as the data processor within the meaning of the GDPR.

9. Availability and maintenance

Domani Equestrian BV strives for high availability of the Service but does not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible. No SLA (Service Level Agreement) applies unless otherwise agreed in writing.

10. Termination

Domani Equestrian BV reserves the right to suspend or terminate an account if the user breaches these Terms & Conditions, misuses the Service, or if required by law.

Upon termination of the subscription, the user has 30 days to export their data. After this period, data will be deleted in accordance with our Privacy Policy.

11. Amendments

Domani Equestrian BV may amend these Terms & Conditions at any time. Material changes will be communicated by email at least 30 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the amended terms.

12. Governing law and disputes

These Terms & Conditions are governed exclusively by Belgian law. Any disputes shall be submitted to the competent courts of the district of Limburg, Belgium.
